The Honourable Mr. Justice Phelan of Canada's Federal Court of Canada on October 14 ,  2010 ruled that Amazon's one-click Internet system fits into the Patent Act's definition of a patent; namely,  "any new and useful art, process, machine, manufacture or composition of matter, or any new and useful improvement in any art, process, machine, manufacture or composition of matter." Mathematical theories, schemes or plans are generally not patentable.  The decision would be positive for those seeking to patent business process methods in Canada. The Commissioner of Patents has 30 days to appeal. Stay tuned.
